SHRM Comments on Colorado ADAI Law Rulemaking
On Dec. 30, SHRM submitted written comments to the Colorado Department of Law (“the Department”) as part of the formal rulemaking process for Colorado’s Anti-Discrimination in AI Law (“Colorado ADAI”).
In its comments, SHRM emphasized the importance of providing clear guidance to developers and deployers of AI systems used in employment and workforce decision-making. SHRM commended the Department for recognizing the benefits AI can bring to the workplace and for striving to avoid stifling technological innovation.
SHRM specifically urged the Department to:
- Clarify the scope of “consequential decisions” in employment.
- Provide detailed guidance on compliance obligations for AI deployers.
- Encourage diverse and equitable applications of AI in human resources.
- Acknowledge the intersection of AI’s benefits with HR practices.
- Address remote work and jurisdictional considerations.
As the Department develops regulations for the ADAI, SHRM is advocating for a balanced approach that empowers Colorado employers to responsibly adopt AI technologies while adhering to antidiscrimination principles. Clear and actionable compliance guidelines are critical to achieving the law’s goals without impeding the innovative use of AI in the workplace.
