DOL Files Notice to Appeal Court Ruling on 2024 Overtime Rule
On Nov. 26, the DOL filed a notice to appeal the Nov. 15 decision by the U.S. District Court for the Eastern District of Texas, which vacated the DOL’s 2024 overtime rule. This rule defined and updated exemptions for executive, administrative, professional, outside sales, and computer employees. With the court’s decision to set aside the 2024 overtime rule, overtime salary thresholds have reverted to the 2020 levels: $684 per week (approximately $35,568 annually) and $107,432 annually for highly compensated employees (HCEs). Notably, this is the same court that previously ruled the 2016 overtime rule under the Obama administration exceeded the DOL’s authority.
