The federal Fair Labor Standards Act (FLSA) requires employers to pay a premium of one and one-half times the regular rate for all hours worked over 40 in a workweek (a defined, seven-consecutive-day period). The FLSA does not require premium pay for daily overtime or premium pay when an employee works on a Saturday, Sunday or a holiday.
Currently, Alaska, California, Nevada, Puerto Rico and the Virgin Islands all have daily overtime laws for working over eight hours in a day. Colorado has daily overtime laws for working over 12 hours in a day. Oregon requires overtime pay for working over 10 hours in a day for employees of manufacturing establishments.
