More employers will be required to submit workplace injury and illness information under a final rule released by the U.S. Occupational Safety and Health Administration (OSHA) on July 17. The new rule will take effect on Jan. 1, 2024. OSHA is amending its regulations to require certain companies to electronically report work-related injury and illness data.

Under the Biden Administration, OSHA will not only return to the Obama-era rule originally promulgated in 2016, but also expand the number of companies that must comply by dropping the threshold number of employees from 250 to 100. The decrease in the threshold number of employees, one estimate said, would require more than 9,300 additional construction firms to comply with OSHA's new electronic recordkeeping requirement.

Under OSHA’s expanded electronic recordkeeping rule, the agency will have access to substantially more injury and illness data than they do today. With this additional data comes increased compliance risks. OSHA is currently authorized to seek and obtain an employer’s injury and illness logs upon request, and such requests are typically made at the outset of an onsite inspection. Under the new regulatory framework, however, OSHA will no longer need to request an employer’s recordkeeping logs in order to obtain injury and illness data.
