ADEA Toolkit
The Age Discrimination in Employment Act (ADEA) protects individuals who are 40 years
of age or older from employment discrimination based on age. The ADEA's protections
apply to both employees and job applicants. Under the ADEA, it is unlawful to discriminate
against a person because of his/her age with respect to any term, condition, or privilege
of employment, including hiring, firing, promotion, layoff, compensation, benefits, job

FLSA Toolkit
The Fair Labor Standards Act (FLSA) was passed in 1938. The Act establishes standards
for minimum wage and overtime pay. For nonagricultural operations, the Act restricts the
hours that children under age 16 can work and forbids the employment of children under
age 18 in certain jobs deemed too dangerous. For agricultural operations, it prohibits the
employment of children under age 16 during school hours and in certain jobs deemed too
