Obama Administration Announces Delay of PPACA 'Employer Mandate' Provision Until 2015
HR professionals across the country are celebrating today, not just in anticipation for Independence Day, but because of the U.S. Treasury Department’s announcement of a one year delay in implementing the employer mandate in the Patient Protection and Affordable Care Act.  While formal guidance is expected in the next week, the agency signaled that employer shared responsibility payments and information reporting requirements will not apply until 2015. Immigration Reform

What HR Needs To Know About the Senate-passed Immigration Bill
On June 27, the Senate passed S.744, the Border Security, Economic Opportunity, and Immigration Modernization Act, by a bipartisan vote of 68 to 32. The comprehensive legislation includes provisions covering border security, legalization procedures for unauthorized aliens, employment-based legal immigration and enhanced employment verification requirements. The bill now heads to the House, but it is unclear whether the House will take up the Senate bill, consider its own version of comprehensive immigration reform or consider a series of “incremental” reform measures. Issue Moves to House; More Work Needed on E-Verify to Protect Against Identify Theft
Prior to a vote on final passage of the Border Security, Economic Opportunity, and Immigration Modernization Act (S. 744) on June 27, Senate Majority Leader Harry Reid (D-Nev.) sought unanimous consent for votes on a package of 32 Republican and Democratic amendments including what was known as the Portman-Tester E-Verify amendment. The bipartisan proposal (SA 1634), cosponsored by Senators Rob Portman (R-Ohio) and Jon Tester (D-Mont.) and strongly supported by SHRM and our strategic affiliate, the American Council on International Personnel (ACIP), was designed to strengthen the employment verification system by streamlining its efficiency while reducing the risk of identity theft. Supreme Court Issues Key HR-Related Decisions
During the week of June 24, the U.S. Supreme Court issued decisions in two cases of importance to SHRM and the HR profession: Vance v. Ball State University regarding supervisor liability and United States v. Windsor challenging the constitutionality of the Defense of Marriage Act. The Court also announced that it will hear the National Labor Relations Board v. Noel Canning case regarding the validity of the Obama administration’s recess appointments to the National Labor Relations Board (NLRB).

SHRM Testifies on NLRB’s Specialty Healthcare Decision
On Wednesday, June 26, SHRM member and Labor Relations Special Expertise Panel co-lead Eric Oppenheim, SPHR, testified before Congress in support of a bill to nullify the NLRB’s 2011 ruling in NLRB v. Specialty Healthcare on so-called micro-bargaining units.
